These Terms of Service ("Terms") are a legal agreement between you and LishWist LLC, 1401 21ST ST STE R, SACRAMENTO, CA 95811 ("LishWist," "we," "our," or "us"), governing your use of our website at lishwist.com and our LishWist mobile app (together, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
You must be at least 16 years old to create an account and use the Service. By registering, you represent that you meet this requirement. Parents and guardians may add information about their own children to their own account for gift-planning purposes, as described in our Privacy Policy, but children do not themselves create accounts or use the Service directly.
You're responsible for keeping your login credentials secure and for all activity under your account. Provide accurate information when registering, and let us know at hello@lishwist.com if you believe your account has been compromised.
The Service lets you create wish lists, occasions, gift ideas, and related content, and share it with people you invite or who follow you ("User Content"). You keep ownership of your User Content, but by posting it you give LishWist a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it solely to operate and provide the Service (for example, showing your wish list to people you've shared it with).
You're solely responsible for your User Content and for having the right to share it, including photos or information about other people (such as children) that you add to your account.
When using the Service, you agree not to:
If you see content or behavior that violates these Terms, you can report it from within the app or website, or by emailing hello@lishwist.com. We review reports and may remove content, restrict a block relationship between affected users, or suspend or terminate accounts that violate these Terms, at our discretion.
The Service contains links to retailers and other third-party websites, including affiliate links from which LishWist may earn a commission (see our Privacy Policy for details). We don't control, and aren't responsible for, the content, policies, or practices of any third-party site you reach through the Service.
The Service itself — including its design, text, graphics, and software, but excluding User Content — is owned by LishWist or our licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, or create derivative works of the Service except as the Service's normal functionality allows (such as sharing a wish list link).
You can delete your account at any time from your profile settings. We may suspend or terminate your account if you violate these Terms, or if we discontinue the Service. Section 7 (Data Retention) of our Privacy Policy describes what happens to your information when your account is deleted.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the Service will be uninterrupted, secure, or error-free, or that any product you find through the Service will meet your expectations.
To the fullest extent permitted by law, LishWist LLC and its owners, employees, and affiliates won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service, even if we've been advised of the possibility of such damages. Our total liability for any claim relating to the Service is limited to the amount you've paid us, if any, in the 12 months before the claim arose.
Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify and hold LishWist harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in California, and you consent to that jurisdiction.
We may update these Terms from time to time. We'll post the updated version here with a new effective date, and for material changes we'll provide additional notice, such as an email or in-app message. Continuing to use the Service after changes take effect means you accept the updated Terms.
